Terms of Service
1. Acceptance and scope
These Terms of Service (Terms) govern your use of RetroMarket, an online marketplace operated from Australia for retro gaming hardware, vintage PC hardware, software, and related collectables. By creating an account, browsing listings, or otherwise interacting with the service, you agree to these Terms and to our Privacy Policy, Acceptable Use Policy, and Cookies & Tracking notice.
When we publish a material change to these Terms, signed-in users will see a re-acceptance prompt the next time they visit RetroMarket. You can always read the current version at this URL.
2. Marketplace facilitator
RetroMarket facilitates connections between buyers and sellers. We are not a party to any transaction between users. We do not take possession of, inspect, photograph, authenticate, ship, insure, or warrant any item listed on the platform. Title to listed items passes directly from the seller to the buyer at a time and on terms agreed between them.
We do not act as an agent, broker, escrow service, payment processor, or guarantor for any user. Where we provide tools that help users organise themselves — messaging, offers, reviews, scammer flags — the decision to transact remains the users' own.
3. Off-platform payment
RetroMarket does not process payments between buyers and sellers. Settlement happens off-platform, directly between the parties. You take on the risk of off-platform payment when you transact. We strongly recommend using a method that offers buyer and seller protection — for example PayPal Goods & Services for posted items, or PayID with in-person inspection for local pickup. We do not recommend bank transfers, cryptocurrency, gift cards, or any payment method that does not include a dispute or chargeback path.
4. Eligibility
You must be at least 16 years old to create an account. RetroMarket is open to users in Australia and New Zealand. New Zealand users are welcome but agree that these Terms are governed by Australian law and that disputes are subject to Australian courts (see §11). We do not geo-block at signup, but features that depend on local infrastructure (e.g. PayID, Australia Post integrations) may be Australia-only.
If you cannot confirm you are 16 or older during signup, you cannot complete account creation. We do not run a parental-consent flow for under-16 users.
5. Account responsibilities
- Keep your login credentials secure and confidential.
- Maintain one account per person. Multi-accounting to evade suspensions or bypass listing limits is grounds for termination.
- Provide accurate signup details and keep your email address current so transactional notifications reach you.
- You are responsible for activity on your account. Notify us immediately if you suspect unauthorised access.
6. Listing rules
All listings must comply with our Acceptable Use Policy. You are responsible for the accuracy of your descriptions, photos, pricing, condition disclosure, and stated postage terms. Misrepresenting an item — for example, listing a reproduction as “original” without disclosing it — is grounds for listing removal and account action.
Where a listing includes software, firmware, or other content that may be subject to copyright, you confirm at the point of listing that you have the right to sell that content (see the Acceptable Use Policy §3 for the full statement and our paralegal-pending review note).
7. Fees and Store subscription
Listing on RetroMarket is free. Optional paid features include the Store tier subscription and listing visibility upgrades (Bump, Featured, Bold). Paid features are billed through Stripe. You can review, manage, and cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period unless we state otherwise.
Pricing and the catalogue of paid features may change. Where a change affects an active subscription, we will give you reasonable notice and the opportunity to cancel before the change takes effect.
8. Intellectual property
You retain ownership of the listing copy, photos, and other content you post to RetroMarket. By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, cache, and distribute that content for the purpose of operating the marketplace — including showing your listings in search results, seller profiles, and email digests.
The RetroMarket name, logo, terminal-styled UI motifs, and the underlying software are owned by the platform operator. You may not copy, scrape, or republish significant portions of the catalogue without written permission.
9. Suspension and termination
We may suspend or terminate your account, remove listings, restrict features, or apply a scammer flag where we reasonably believe you have breached these Terms, the Acceptable Use Policy, or applicable law. Repeated or serious breaches typically result in permanent termination. Enforcement decisions are made by the operator at their discretion; the AUP describes the limited appeals path.
You may close your account at any time from your account settings. Account deletion anonymises your profile after a seven-day grace window so counterparties retain a stable reference to past transactions. See the Privacy Policy §9 for details.
10. Liability disclaimer
To the maximum extent permitted by law, RetroMarket disclaims all warranties, conditions, and liabilities relating to your use of the platform and any transaction conducted through it. This includes — without limitation — the accuracy or legality of listings, the conduct or solvency of other users, the quality or fitness of items, off-platform payment outcomes, and any loss arising from delays, downtime, or data inaccuracy.
Nothing in these Terms excludes, restricts, or modifies the non-excludable consumer guarantees in the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including the consumer guarantees in section 64. Where a consumer guarantee applies and is breached, your remedies are as set out in that Act and cannot be contracted out of by these Terms.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Australia and the State of Victoria. You and RetroMarket submit to the non-exclusive jurisdiction of the courts of Victoria, Australia, and the federal courts sitting in Australia, for any dispute arising out of or in connection with these Terms.
12. Changes to these terms
We may update these Terms from time to time. When we publish a material change, signed-in users will see a re-acceptance prompt at the top of the next page they visit. The footer on every legal page shows the current version and as-at date. If you do not accept a new version, you cannot continue to use the platform — you can still export your data and close your account from the settings page.
